The President of a grade C Customary Court, Mapo in Ibadan, Chief Ademola Odunade, on Tuesday, dissolved a six-year-old marriage between a female banker, Atinuke Oluwadamilare and her husband, Ibitoye over childlessness and endless battery.
Odunade held that there was no need keeping the marriage since Atinuke had refused to be pacified.
“In the interest of peaceful living, the union between Atinuke and Ibitoye has ceased to be.
“Ibitoye is advised to refund all outstanding debt to Atinuke and must allow her to move her belongings in his custody” the Arbitrator said.
Earlier, Atinuke had informed the court that her husband lacked milk of human kindness as he frequently subjected her to injurious battery.
“My lord, if I had known that my marital journey with Ibitoye would be filled with storms, I would have retracted my steps.
“No sooner had I moved into Ibitoye’s home as a wife that he started unleashing battery on me.
“This is even to the extent that he doesn’t take care of my physical, emotional and material needs.
“most of the time, Ibitoye locks up the door and beat me until he is satisfied if I dare query why he doesn’t come home early.
“In fact, I have become a nightwatch in our house because he only retuns home in the dead of the night; 12 or 1 am, drunk.
“Not minding that I open the gate for him, he still beats me, thereby exposing me to psychological torture.
“Ibitoye does not spend anytime with me at home, instead, he goes to his friends at University of Ibadan to lavish his earnings and drink to stupor.
“Aside from not doing anything about our childlessness for six good years, Ibitoye has plunged me into a huge debt due to the fact that he doesn’t repay the series of loans I have acquired for him.
“I have used my influence as a banker to on different occasions obtain loans for him, but he keeps squandering the loan without repaying.
“My lord, it is not by force, I can’t continue to stay in hopelessness of six years,” Atinuke lamented.
In his response, the respondent who denied all the allegations leveled against him however, opposed the marriage dissolution.
Ibitoye who earned his livelihood as a businessman explained that he usually stock the home up with more than enough food for their consumption.
“I have told Atinuke not to bother herself on the issue of childlessness because God is the giver.
“Though, I am still oweing Atinuke over N200,000, but the matter is not exactly as she has painted it.
“She is merely making up issues out of nothing,” Ibitoye explained.
The respondent was however, silent on the issue of frequent battery.
